Party Wall Rules for Installing an RSJ (Rolled Steel Joist)
Yes, if the RSJ bears on or is set into a party wall, you normally need to serve a party wall notice. Inserting a steel beam is listed work under Section 2 of the Party Wall etc. Act 1996. Serve at least two months before the work starts.
Why an RSJ counts
A rolled steel joist is often installed to carry loads where an internal wall is removed. The ends must sit on padstones, which usually means cutting a recess into the wall on each side of the opening. If either end goes into a party wall, you are altering a party structure.
When it may not count
If the beam sits fully within your own walls and no part touches the shared wall, the Act is not engaged. Your structural engineer's drawings should show where each bearing is. Do not guess from the builder's description alone.
What to serve and when
Serve a written notice describing the beam and its location, at least two months before you start. The notice lapses if work has not begun within twelve months. Include the engineer's calculations or drawings if you can, as that makes the neighbour's response quicker.
Neighbour's options
The adjoining owner has 14 days to reply. They may consent, dissent, or say nothing. If they dissent or fail to respond, surveyors are appointed and an award is made. The award sets how the beam is fitted, working hours, access and a schedule of condition.
Damage and repairs
If fitting the beam cracks plaster or disturbs the neighbour's chimney or ceiling, the building owner must make good the damage or pay for it. A schedule of condition taken beforehand is the best evidence of what was there.
Keep the engineer's drawings, the notice, any consent and the award together in one file. If you sell the house later, a buyer's solicitor may ask to see them, and they show the beam was fitted with the neighbour's rights respected.
