Before you serve it

• The start date must be at least the notice period after the date the neighbour receives the notice, and work must begin within 12 months.
• Attach drawings. For excavation, attach plans and sections and say whether you will underpin or strengthen the neighbour's foundations.
• Serve it properly: by hand, or by post to their address. Keep proof.
• Your neighbour has 14 days to respond. If they consent, keep it in writing. If they dissent or say nothing, surveyors are appointed.
• Many building owners ask their surveyor to prepare and serve the notice, which reduces the risk of an invalid notice.
