Frequently asked questions

Which party wall notice do I need?

It depends on the work. A new wall on the boundary needs a Section 1 notice, work to an existing party wall needs a notice under Section 3 (covering the Section 2 rights), and digging near a neighbour needs a Section 6 notice.

Can I use a template instead of a surveyor?

You can serve a notice yourself. A notice is not the same as an award: if your neighbour dissents or does not reply, surveyors must be appointed.

Is a notice by text or email valid?

Notices should be in writing and served in one of the ways the Act allows, so a signed paper notice by hand or post is the safest route. Check with a surveyor if you plan to serve electronically.
